A High court in Ilorin has issued an order of interim injunction against a traditional ruler in Edu local government area of Kwara State and Etsu of Tsaragi, Alhaji Aliyu Abdullahi Kpotwa, from removing or dealing in any manner with the stool of head of the Ndadzoko of Tsaragi emirate, Alhaji Attahiru Haruna Abdulkadir.
The court presided over by Justice I. A. Yusuf, also ordered that parties in the suit KWS/455/2023, should maintain status quo pending the hearing and determination of the motion on notice.
The claimant, Alhaji Attahiru Abdulkadir, who is also chairman of Kingmakers of the emirate, was appointed and turbaned in 2016.
The order also restrained the emir from dealing with the lands belonging to the claimant (Alhaji Abdulkadir), pending the hearing and determination of the motion on notice.
Part of the order of interim injunction also said that: “Interim injunction restraining the 1st Defendant from appointing or turbanning the 2nd Defendant (Tetengi Tahidi Ndadzoko) or anybody whosoever as a parallel or new Ndadzoko of Tsaragi pending the hearing and determination of the motion or notice.
“Interim injunction to restrain the 2nd Defendant from parading himself as head of Ndadzoko family pending the hearing and determination of the motion on notice, “it said.
Counsel to the claimant, I.B. Ayegbami, moved the motion ex-parte, while the court having considered the application moved, went ahead to grant same.
Justice Yusuf later adjourned to December 12, 2023 for hearing of the motion on notice already filed.
